These Terms and Conditions govern access to and use of the SouqHub website, mobile applications, marketplace services, vendor services, delivery-related services, and any related features or content (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

Unless expressly stated otherwise, SouqHub is a marketplace facilitator and does not manufacture, own, or independently sell the products listed by third-party vendors.

2. Eligibility and Account Registration

You must provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out through your account. You must promptly notify us if you suspect unauthorized access or a security breach.

You may not create an account using another person’s identity, provide misleading information, operate multiple accounts for abusive purposes, or use the Platform if you are legally prohibited from doing so. Where required by applicable law, users under the legal age must use the Platform with the involvement and consent of a parent or legal guardian.

3. Marketplace Vendors

Vendors are responsible for the accuracy of their product listings, prices, availability, descriptions, images, warranties, certifications, and other information they provide. A vendor’s use of the Platform may be subject to additional vendor terms, onboarding requirements, commission arrangements, payment procedures, service standards, and verification processes. SouqHub may review, suspend, remove, or restrict listings or vendor accounts where it reasonably believes that a violation, risk, fraud, or customer-safety concern exists.

4. Product Information and Availability

Product information is provided by vendors and may change without notice. We encourage customers to review the product description, specifications, size, color, condition, warranty, delivery information, and return terms before placing an order. We do not guarantee that product images, colors, descriptions, or measurements will be completely accurate on every device or screen.

Products may be unavailable, incorrectly priced, discontinued, or subject to quantity limits. SouqHub or the relevant vendor may cancel or correct an order affected by an obvious listing or pricing error, subject to applicable law and any refund obligations.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted. An order is accepted when the vendor or SouqHub confirms fulfillment, dispatches the order, or otherwise communicates acceptance.

We may refuse, cancel, or limit an order for reasons including product unavailability, pricing or listing errors, suspected fraud, payment failure, delivery limitations, violation of these Terms, or other legitimate operational or legal reasons. If payment has already been collected for a cancelled order, the applicable amount will be refunded in accordance with the payment provider and applicable law.

6. Prices, Payments, and Promotions

Prices, delivery charges, taxes, fees, discounts, and promotional terms will be displayed where applicable before checkout. The total amount may vary based on the delivery address, selected payment method, applicable taxes, vendor settings, or other checkout details.

Payments may be processed by third-party payment providers. By submitting payment information, you confirm that you are authorized to use the selected payment method. SouqHub may use payment authorization, fraud screening, and verification procedures to protect customers and the marketplace.

Promotional campaigns, including vendor onboarding offers or commission incentives, may be subject to specific eligibility requirements, time limits, order limits, exclusions, and additional terms. Unless expressly stated otherwise, promotions cannot be combined, exchanged for cash, or applied retroactively.

7. Delivery and Fulfillment

Delivery estimates are provided for guidance and may be affected by vendor preparation time, product availability, destination, weather, public holidays, traffic, operational disruptions, or events outside reasonable control. Customers are responsible for providing an accurate delivery address and being available to receive the order or following any available delivery instructions.

Risk relating to a product may pass to the customer upon delivery, receipt by an authorized person, or another point required by applicable law. Delivery partners may be independent contractors or third-party service providers. Their availability and service terms may vary by location.

8. Returns, Refunds, and Exchanges

4. sell, purchase, promote, or distribute prohibited, counterfeit, stolen, unsafe, or unlawful products;
5. harass, threaten, impersonate, or harm customers, vendors, delivery partners, employees, or other users;
6. attempt to gain unauthorized access to accounts, systems, APIs, or security features.

10. User Content and Reviews

If you submit reviews, ratings, images, comments, product questions, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and not misleading. You retain ownership of your content, but you grant SouqHub a non-exclusive, worldwide, royalty-free, transferable license to host, reproduce, display, adapt, and use it for operating, improving, marketing, and promoting the Platform.

We may remove or restrict content that violates these Terms, applicable law, intellectual-property rights, privacy rights, or marketplace standards. Reviews must reflect genuine experiences and must not be exchanged for unauthorized compensation or used to manipulate marketplace rankings.

11. Intellectual Property

The SouqHub name, logos, designs, software, interfaces, text, graphics, systems, and other Platform materials are owned by or licensed to SouqHub and are protected by applicable intellectual-property laws. You may use the Platform only for its intended personal or business purposes. You may not copy, modify, distribute, reverse engineer, sell, or commercially exploit Platform materials without prior written permission.

12. Privacy and Electronic Communications

Our collection and use of personal information is described in the SouqHub Privacy Policy, which forms part of these Terms by reference. By using the Platform, you consent to receive electronic communications relating to your account, orders, transactions, security, customer service, and Platform updates. Marketing communications may be managed through the available unsubscribe or account settings.

13. Third-Party Services and Links

The Platform may use or link to third-party payment providers, delivery services, map services, communication tools, social networks, or other external services. Third-party services may have their own terms and privacy policies. SouqHub is not responsible for the availability, content, security, or independent practices of third-party services except to the extent required by applicable law.

14. Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an “as available” and “as is” basis. We do not guarantee uninterrupted access, error-free operation, complete accuracy of every listing, or that every product or vendor will meet your expectations. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

15. Limitation of Liability

To the maximum extent permitted by law, SouqHub will not be liable for indirect, incidental, special, consequential, or punitive losses, loss of profits, loss of data, or business interruption arising from use of the Platform or a transaction, except where such liability cannot be excluded by law. Any applicable liability cap should be completed by legal counsel based on the governing jurisdiction and business structure.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless SouqHub, its affiliates, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the Platform, violation of law or third-party rights, or content you submit.
